Implementation of revised Local Rules effective November 15, 2014

On August 19, 2014, the Court published for public comment proposed Local Rules of the United States Bankruptcy Court for the District of New Mexico. Comments were received and reviewed. The Court has ordered that revised Local Rules are adopted effective November 15, 2014. The revised rules are posted on the Court’s web site along with a copy of the Court order adopting those rules. The revised Local Rules apply to new cases and adversary proceedings filed on or after November 15, 2014 and to pending cases and proceedings insofar as just and practicable.

One particular item of note is revision to LBR 5005-2 with removal of language referred to as the “drop box” rule. This revision was a result of comments received during the comment period. The revised rule reads:

(c) After Hours Electronic Filing. Unless otherwise ordered, any paper filed electronically must be filed before midnight local time to be considered timely filed that day.
